Tortured logic

Favorite line in AP story today on White House spokesman explaining why a certain technique is not torture: "Fratto said waterboarding's use in the past was also approved by the attorney general, meaning it was legal and not torture." So if he approved cutting off fingers it would also not be torture -- because it was "legal"?
